Terms of Service

Agreement

These terms are between you and DitherCharts, LLC. They cover dithercharts.com, the DitherCharts CLI and DitherCharts Pro. By using any of them, you agree to these terms and our Privacy Policy. If you use DitherCharts for a company, you agree for that company.

Accounts

You must be at least 18, or the age of majority where you live. Give accurate details and keep your sign-in secure. You're responsible for what happens under your account.

Pro purchase and billing

Pro is a one-time purchase at the price shown at checkout, plus any tax. It doesn't renew, and you won't be charged again.

Purchases are made through Sold through Link, LLC, a Stripe company that is the merchant of record and handles payment and tax. Link's terms also apply to your purchase.

Pro doesn't expire: you keep access to new charts, controls and updates for as long as we offer DitherCharts. A price change only affects future purchases.

Refunds

Refund requests are handled under Link's refund policy. You can also email support@dithercharts.com and we'll help. Nothing here limits refund rights you have by law.

License

The DitherCharts source you install is licensed under the Pro license. We keep all rights to DitherCharts, its source, name and site that the license doesn't give you.

CLI and API keys

Your API keys are personal. Keep them secret, and don't share them with anyone your license doesn't cover. We may rate-limit requests and revoke keys that are leaked or misused.

Acceptable use

Don't break the law with DitherCharts, attack or overload the service, get around access limits, scrape the paid source, or resell or redistribute it beyond what the license allows.

Ending these terms

You can stop using DitherCharts and delete your account at any time. We can suspend or close an account that breaks these terms. Source you installed while you followed the terms stays licensed as the Pro license describes.

No warranty

DitherCharts, its source and the service are provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent the law allows, DitherCharts, LLC isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business. Our total liability for any claim is limited to what you paid us in the 12 months before it.

You'll defend and indemnify DitherCharts, LLC against claims that come from your misuse of DitherCharts or your breach of these terms.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws rules. Disputes go to the state or federal courts in Virginia, unless the law where you live gives you the right to bring them locally.

Changes

We may update these terms. We'll change the date on this page and email account holders about significant changes before they apply. Questions go to support@dithercharts.com or the contact form.
